This consolidated appeal arises out of a lawsuit filed by appellant Mrs. Burnett Brown on account of the death of Mrs. Browns son, Mark Anthony Brown, a student athlete at Prairie View A & M University. Mark Anthony Brown collapsed during football practice on August 19, 1976, and was taken to Waller County Hospital in Hempstead, Texas, where he died the next day of sickle cell crisis.
