The defendant-appellant National Trade Publication Service, Inc., appealed from a denial of its motions for summary judgment to dismiss the complaint made on the ground (1) the appellant was not doing business in Wisconsin and, therefore, the court had no jurisdiction, and (2) the defendant Jesse J. Harrel was an independent contractor and the appellant was not liable for his or his agents' torts. The action was brought by the respondents Mrs. Joseph Bond to recover for the wrongful death of her son Thomas Bond, and by Roswell Bond for damages to his automobile which was driven by Thomas Bond, as a result of an accident in Equ Claire county on September 1, 1957, when an automobile driven by the defendant Leona Harrel and owned by her defendant husband Jesse J. Harrel collided with the car operated by Thomas Bond. The appellant, a foreign corporation, was made a party defendant on the theory it was doing business in Wisconsin and Jesse and Leona Harrel were its agents. Service of the complaint was made on the president of appellant in Missouri.
